Rep. Boggs testifies on her bill to remove the marital rape law loophole

COLUMBUS– State Rep. Kristin Boggs (D-Columbus) today gave sponsor testimony before the Ohio House Criminal Justice Committee on House Bill (HB) 121, her legislation to eliminate Ohio’s spousal exemptions for sex offenses and permit spousal testimony.

“The marital rape exception law is archaic and should have been changed a long time ago,” said Rep. Boggs. “HB 121 will correct the criminal code and ensure that a person’s legal relationship can’t be used to justify rape.”

This legislation would: 

  • Eliminate exceptions to certain sex offenses that currently apply if the victim is the spouse of the offender; 
  • Expand the proceedings in which a person may testify against the person's spouse to include prosecutions for any of the sex offenses modified by the bill.

HB 121 now awaits further hearings in the House Criminal Justice Committee.
