Rep. Merrin's Bill Providing Increased Protection from Unfair Tax Complaints Approved by Ohio House

COLUMBUS—State Representative Derek Merrin (R-Monclova Township) today announced that legislation he sponsored was approved by the Ohio House of Representatives with a 59-39 vote. House Bill 343 adds additional protection to property owners facing valuation complaints from local governments leading to increased property taxes owed and legal costs to litigate the challenges.

“It’s a victory for every property owner in Ohio. Too many Ohioans are being targeted by high-powered attorneys funded by local governments to try to increase their property taxes by hiking their property valuations,” said Representative Merrin.

The bill requires legislative authorities to pass resolutions authorizing property tax complaints rather than the common practice of private-sector attorneys filing them on behalf of local governments with little oversight. Also, the bill requires local governments to provide written notification to property owners when the resolution regarding their property will be on the legislative agenda.

Representative Merrin has contended some elected officials are unware that their school districts are filing complaints or know of the hardball legal tactics being used against Ohio business owners and residential property owners.

“There are predatory and frivolous tax complaints being filed attempting to force property owners to settle. We must have more transparency and provide for protection for Ohioans,” said Merrin.

The Ohio Chamber of Commerce strongly supports the bill. According the Ohio Legislative Service Commission, only 12 states, in one form or another, allow local governments to challenge property values.

House Bill 343 now awaits further consideration by the Ohio Senate.
